Advising a Third-Party Litigation Funder on the ‘Dieselgate’ Scandal

  • Byfield was instructed by a leading third-party litigation funder who was preparing to launch the first shareholder action against VW, to compensate for the huge fall in the company’s share price resulting from the emissions scandal. We were engaged to raise awareness of the claim and attract institutional shareholders to make further enquiries through a dedicated website that we had helped to build.

Counsel:

  • Our first job was to help create a microsite on the client’s website. with information for shareholders about joining the group action. Byfield’s international media relations strategy involved careful drafting of the press communications to explain the action and to invite claimants to join the group. Working closely with our partner PR Agency in Germany, where the claim was initially filed, we conducted extensive media liaison across Europe to make journalists aware of the litigation and the funding element.

  • In supporting this litigation, Byfield generated over three hundred pieces of international coverage in titles including Financial Times and The Wall Street Journal (Europe). This resulted in a significant amount of interest in joining the action from affected parties.
